As an inclusive online community, we take the privacy of our users very seriously. We fully respect all requests to keep personal user information confidential. We are aware of the need to adequately protect and handle all personal information we receive and process confidentially and work continuously with measures designed to keep our users safe. We recommend that you read all our policies, our Terms of Use, Service Agreement and Code of Conduct before you register an account or use our services. If you do not agree to the way we process your personal information, as set out in this Privacy Policy, you should not visit or use our sites and services.

What is “personal information”?

Personal information or personal information means information that can be used to identify a living individual. This includes but is not limited to a person's first and last name, age, gender, home address or other physical address, e-mail address or other contact information related to the person's home or workplace. It can even include information such as your username, avatar, chats, comments, IP address, audio recordings and images of you.

What personal information do we collect and process?

We provide a gaming community and forum enabling our users to swap comments, exchange information and to compete in games of skill against each other, in order to do this, we need to collect and process information about you when you want to use the services. For example, in order for you to become a By Mates user you will need to create a user account with the information that you provide in the online registration forms, or you may want to make changes or update your user account. We only collect and process as much personal information as we need to be able to provide the service and safeguard our users and our own interests. Where necessary, we will ask you to indicate your consent to any processing of your personal information.

As a rule, we will not retain personal information for any purpose or purposes for longer than is necessary to fulfil the purposes we collect it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. For more specific retention periods, see the retention information given for each category included in this Privacy Policy. When deciding the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. In some circumstances we may anonymise your personal information (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

Who gets access to the personal information?

Your personal information is not sold to any third party. We use the personal information for internal purposes only and it is shared only with our suppliers and processors who are contractually bound in terms of confidentiality and limited to processing the personal information in strict accordance with our instructions. Internally our staff are bound to keep personal information confidential and access is limited to those persons needing to use the personal information. In addition, we only share personal information with an abuse register and the like in accordance with the applicable legislation in cases where a user potentially exposes By Mates or others to abuse or fraud.

Where is the personal information stored and processed?

We store and process your personal information on servers in Sweden.

Access to personal information for viewing, correcting, changing and deleting.

You can log in to your user account to review, amend, change and delete your account information at any time.  If you wish, you can find out what personal information we store about you by contacting us at informationprivacy@mates.gg.

What categories of personal information do we process and how is it processed?

First and last names.

Collection: entered by you when you activate your user account.

Purpose: personal identification within the By Mates community and services.

Basis: consent; entering your name in the user account is optional.

Changing or correction: only you, as a user can edit your own names, you can do it at any time.

Deletion: at any time by you in your user account, it is deleted automatically if you close your account, and in certain cases we (Super-admin) can delete the user account. 

Retention: maximum three months after deletion in back-up systems.

Email address

Collection: entered by you when you activate and verify your user account.

Purpose: necessary for verification of the account, to log in, to communicate and receive information, to receive updates and product and services information, to verify security and ensure no double accounts are created.

Basis: according to contract for enabling the service to be provided, and legitimate interest for marketing our products and services, quality surveys and service feedback, and fraud checks and security measures.

Changing or correction: only you, as a user can edit your email address, you can do it at any time.

Deletion: at any time by you in your user account, it is deleted automatically if you close your account, and in certain cases we (Super-admin) can delete the user account. 

Retention: 36 months after deletion where they are retained to meet any contractual claims, 36 months from deletion where retained for prevention of fraud by banned users, 12 months from deletion where they are retained for ensuring the security of users and other persons, plus a further 3 months from deletion for all purposes for system back-up purposes.

Phone Number

Collection: entered by you when you activate and verify your user account.

Purpose: necessary for verification of the account, to log in, to communicate and receive information, to receive updates and product and services information, to verify security and ensure no double accounts are created.

Basis: according to contract for enabling the service to be provided, and legitimate interest for marketing our products and services, quality surveys and service feedback, fraud checks and security measures.

Changing or correction: only you, as a user can edit your phone number, and only prior to verifying your account to be able to use a service.

Deletion: at any time by you in your user account, it is deleted automatically if you close your account, and in certain cases we (Super-admin) can delete the user account. 

Retention: maximum three months after deletion in back-up systems.

Profile Image

Collection: uploaded by you when you activate your user account.

Purpose: personal identification within the By Mates community and services.

Basis: consent; entering your image in the user account is optional.

Changing or correction: only you, as a user can edit your images, you can do it at any time.

Deletion: at any time by you in your user account, it is deleted automatically if you close your account, and in certain cases we (Super-admin) can delete the user account. 

Retention: maximum three months after deletion in back-up systems.

Date of birth

Collection: entered by you when you activate your user account.

Purpose: to verify eligibility to certain services and to exclude direct marketing communications to minors.

Basis: consent; entering your name in the user account is optional.

Changing or correction: only you, as a user can edit your own names, you can do it at any time.

Deletion: at any time by you in your user account, it is deleted automatically if you close your account, and in certain cases we (Super-admin) can delete the user account. 

Retention: maximum three months after deletion in back-up systems.

Gender

Collection: entered by you when you activate your user account.

Purpose: to enable us to target information more appropriate to you, and we may aggregate and anonymise this personal information to analyze the demographic of our users for our services in order to improve our services and equal opportunity and inclusion in the community.

Basis: consent; entering your name in the user account is optional.

Changing or correction: only you, as a user can edit your persona information, you can do it at any time.

Deletion: at any time by you in your user account, it is deleted automatically if you close your account, and in certain cases we (Super-admin) can delete the user account. 

Retention: maximum three months after deletion in back-up systems.

IP-address

Collection: automatically when logging in and using the services.

Purpose: to prevent fraud, cheating and for enabling security of the users within the system.

Basis: legitimate interest in providing security and preventing cheating, abuse and fraud.

Changing or correction: the IP address cannot be changed, altered or edited.

Deletion: automatically 12 months from the closing of a user account, and 36 months from the termination of a banned user account. 

Retention: 36 months after deletion where they are retained to meet any contractual claims, 36 months from deletion where retained for prevention of fraud by banned users, 12 months from deletion where they are retained for ensuring the security of users and other persons, plus a further 3 months from deletion for all purposes for system back-up purposes.

MAC-adress

Collection: automatically when logging in and using the services.

Purpose: to prevent fraud, cheating and for enabling security of the users within the system.

Basis: legitimate interest in providing security and preventing cheating, abuse and fraud.

Changing or correction: the IP address cannot be changed, altered or edited.

Deletion: automatically 12 months from the closing of a user account, and 36 months from the termination of a banned user account. 

Retention: 36 months after deletion where they are retained to meet any contractual claims, 36 months from deletion where retained for prevention of fraud by banned users, 12 months from deletion where they are retained for ensuring the security of users and other persons, plus a further 3 months from deletion for all purposes for system back-up purposes.

Chats, posts, comments and private messages with text that may contain personal information

Collection: posted and entered by you on the sites and services.

Purpose: posting and exchanging texts and posts, comments and private messages is a core service in the By Mates community and is necessary for members to share information between each other in the Services

Basis: consent, it is entirely voluntary to communicate with other users, we retain a copy of the messages for three months after deletion for back up, ensuring the safety of users, and in order to meet any contractual claims.

Changing or correction: you can delete any posts that you have made public, and private messages that you have sent on your terminal/account, you cannot delete private messages or texts you have sent that are received on another user’s or person’s terminal, 

Deletion: at any time by you in your user account, they are deleted automatically if you close your account, and in certain cases we (Super-admin) can delete the user account including personal information contained in the posts and texts etc. 

Retention: 36 months after deletion where they are retained to meet any contractual claims, 12 months from deletion where they are retained for ensuring the security of users and other persons, plus a further 3 months from deletion for all purposes for system back-up purposes.

Your privacy rights

Data protection laws provide you with certain rights when it comes to the processing of your information. These are the right to:

The right to be informed

You have the right to be informed about how we collect and process your personal information, including who we are, how we use your personal information and your rights in relation to your personal information. We have gathered all the information you need in this privacy notice.

The right of access your information

You have the right to access the personal information we have on you. We can confirm whether or not your information is being processed and provide you with access to your personal information.

The right to correct your information

If your personal information is inaccurate or incomplete, you are entitled to have that information corrected and updated. If we have disclosed your information to any third parties, where possible, we will inform them of any updates you provide to us. You can update the personal information we hold about you by logging in to your user account at any time.

The right to delete your information

You have the right to request the deletion or removal of your personal information where there is no reason for us to continue to process it. The circumstances in which you can request the right to be forgotten includes, where the information is no longer necessary in relation to the purpose for which it was originally collected or processed and where you have withdrawn your consent to processing. However, there are some limited circumstance where the right to be forgotten does not apply, for example where we need to retain and use the information to meet our own legal obligations or to deal with any contractual claims.

The right to restrict processing

You also have the right to ‘block’ or suppress the processing of your personal information in certain circumstances. If you request us to suppress your personal information, we will stop any further processing of it for those purposes.

The right to transfer information

In certain circumstances, if you want to move or transfer your personal information to a different service provider or copy your information for your own purposes, you have the right to have your information transferred to another person.

The right to object

You have the right to ask us not to process your personal information for marketing purposes. We will usually inform you (before collecting your information) if we intend to use your information for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your information.

We will work with you to resolve any issues you may have and aim to answer any question raised by you as soon as possible. You can also make a complaint to the Swedish information protection authority “Datainspektionen” at any time, but we do encourage you to contact us so we can resolve any problems or misunderstandings together.

We may change our policy from time to time. Any changes we make to this policy in the future will be posted on this page. If you have an online account with us, we may notify you of any changes by email or through your account the next time you log on.
